Legal Action Taken to Invalidate Patent Owned by Fameccanica
Sheboygan Falls, WI (April 21, 2016) – Curt G. Joa, Inc. filed and served a lawsuit against Fameccanica Data, SpA to invalidate a patent owned by Fameccanica. The case, filed in the United Kingdom High Court of Justice Intellectual Property Enterprise Court (Case No. IP – 2015 – 000205) alleges invalidity of European Patent (UK) number 1355604 entitled “Disposable Absorbent Garment such as a diaper or training pants and a process of making the same.”
In its complaint, Joa alleges that other patents prior in time to European Patent (UK) number 1355604 disclose the invention claimed in Fameccanica’s patent: a breathable, stretchable layer assembly including an inner material layer, an outer material layer and a stretchable material layer disposed there between and including vent sites which are formed by ultrasonic bonding of the inner and outer material layers through the stretchable material layer.
